We invite you to read carefully the present general conditions of sale (the "GTC") which govern the navigation on this Site as well as our relations if you order Products and services on this Site.

Any order for a Product offered on the Site requires the consultation and express acceptance of the Terms, but this acceptance is conditioned by a handwritten signature on your part.

In accordance with the applicable legislative and regulatory provisions and relating to the electronic signature, it is recalled that the validation of the purchase order as specified in these T & C constitutes an electronic signature which has, between the Parties, the same value as a signature. handwritten and is proof of the completeness of the order and the exigibility of the sums due in execution of the said order.

The amount corresponding to the unavailable Products is then refunded to the buyer within a maximum of fourteen (14) days from the notification of non-availability sent to the buyer according to the payment method used by the Buyer.

In the event that the Buyer requests the cancellation of the entire order, the Seller undertakes to reimburse the Buyer for the sums paid by him within a maximum of fourteen (14) days from the date of the order. date of receipt of the request, depending on the method of payment used by the Buyer. 2.2 PRICE

Prices are quoted in Euros (€) and are valid in mainland France, Corsica and Belgium. They take into account possible reductions as well as the T.V.A., applicable on the day of the order.

3.1 CONFIRMATION OF THE ORDER

An order confirmation e-mail is then sent as soon as possible by the Seller to the e-mail address provided by the Buyer.

The Seller retains ownership of the Product (s) ordered until full payment of the order. In the event of a payment incident, the Buyer undertakes to return the products received to the Seller on the first request.

4 PAYMENT

The amount due by the Buyer is the amount indicated on the order confirmation as displayed on the dedicated web page and then sent by e-mail by the Seller to the Buyer.

The Buyer has the choice during the validation of his order as specified above, between different payment methods.

Payment can be made immediately by internet by credit card.

The order is validated by the Seller only after acceptance of the GTC and verification and confirmation of the validity of the payment.

The Seller reserves the right to refuse any order or delivery in case of exceeding the ceilings indicated in article "Terms of Purchase" herein, existing dispute with the Buyer, total non-payment of a previous order by the Buyer, refusal to authorize payment by credit card of banking institutions or non-payment.

 

5 DELIVERY AND RECEPTION

5.1 DELIVERY

Bachca.com is committed to ensuring the delivery of products in the best conditions. The products are packaged in suitable packaging and shipped by one of the modes of transport available at the time of order (So Colissimo, Point Relay, UPS, TNT, Geodis Calberson).

From Monday to Friday, if the product is in stock, the order is shipped within 24h after validation of the buyer's payment. The order is sent to the address indicated by the buyer during the validation of the order.

The buyer undertakes to verify that the coordinates indicated during the validation of the order are accurate and gives a mobile phone number so that the driver can contact him if necessary. The buyer must make sure to be present or represented at the estimated delivery date. In case of absence of the Buyer, the Carrier leaves a notice of passage in the mailbox of the Buyer. The Buyer must then contact the Carrier to arrange a new delivery date. It is nevertheless stipulated that if the Buyer does not contact the Carrier, the latter will perform two new delivery tests, the date and time of which will be determined by the Carrier on a discretionary basis.

The Buyer is informed that the parcel is kept by the delivery person for a period of ten (10) days after the first presentation.

Delivery in metropolitan France takes between 2 and 3 days depending on the destination and the shipping method chosen (SoColissimo, UPS, TNT).

For deliveries abroad, delays vary depending on the destination.

The order is executed within a maximum of thirty (30) days from the day following the day on which the Buyer validated his order, subject to full payment of the price.

In case of exceeding the maximum delivery time of thirty (30) days, the Buyer may exercise his right to denounce the order to the Customer Service contact@bachca.com.

Upon the exercise of the right of termination, the Seller shall refund all amounts paid by the Purchaser (delivery charges included), depending on the method of payment used within a maximum of fourteen (14) days in advance. from receipt of the information, to the exclusion of any other compensation.

In case of partial delivery, the delivery can be made in several times, and this right concerns only the undelivered balance of the order.

Any delay in delivery must be reported as soon as possible by the Buyer by e-mail to the address contact@bachca.com, so that the Seller can make an inquiry with the Carrier. The Buyer is informed that the duration of completion of an investigation is random and can be relatively long, the Seller does not control its realization.

If during this inquiry, the order is found, it is immediately redirected to the place of delivery specified in the order.

If at the end of this inquiry the loss of the order is confirmed, the Seller shall, at his own expense, resend the Product (s) to the Buyer or, in the event of definitive unavailability, refund to the account bank or the Paypal account debited when ordering, the Buyer sums cashed.

5.2 RECEPTION

Each delivery is deemed made as soon as the Product (s) is made available to the Buyer by the Carrier.

It is the responsibility of the Buyer to check immediately upon receipt of the Product (s) the conformity and integrity of the Product (s) shipped.

Any anomaly / reserve identified at the time of delivery (including late delivery, missing or damaged product) must be fully and accurately indicated by the Buyer on the receipt given by the Carrier at the time of the provision of Products and confirmed by registered letter to the Carrier within three (3) days of receipt of the order.

Any such reservation must be notified in parallel and as soon as possible to the Customer Service of the Seller contact@bachca.com. A copy of the complaint addressed to the Carrier must be attached.

 

6 LEGAL GUARANTEES

In accordance with Articles L 211-4 et seq. Of the Consumer Code, the Seller is obliged to deliver goods in conformity with the order made by the Purchaser and must answer for any lack of conformity existing at the time of the delivery of the latter.The property must therefore be fit for the customary use of a similar good and correspond to the description given by the Seller, the producer or his representative, particularly in advertising or labeling.

Similarly, in accordance with article 1641 of the Civil Code, the Seller is bound by the guarantee for the hidden defects of the thing sold which render it unsuitable for the use for which it is intended, or which diminish so much this use that the The purchaser would not have acquired it, or would have given it a lesser price, had he known it.

If the delivered Products are not in conformity with the Products ordered by the Buyer or if they present vices-hidden, it must send an email to the Customer Service of the Seller contact@bachca.com to notify him the non-conformity or the hidden vices of his Product(s).

In accordance with article L 211-12 of the Consumer Code and 1648 paragraph 1 of the Civil Code, the Purchaser has a period of two (2) years from the date of delivery of the Products purchased to exercise the guarantee against hidden defects or the legal guarantee of conformity. Any claim made after this period of 2 (two) years from the date of taking possession of the property in case of non-compliance or from the discovery of the defect in case of hidden defects will be rejected and Bachca will be released from any responsibility.

The Customer Service of the Seller acknowledges receipt of the request of the Buyer and confirms the procedure to follow. Upon receipt of the Seller's customer service instructions, the Buyer returns the non-compliant or defective Products to the Seller at the following address:

In addition, the Seller does not accept parcels sent freight collect. Any risk related to the return of the Product (s) is the responsibility of the Buyer.

On receipt of the Product (s), the Seller carries out a check of the Product (s) to ascertain the conformity or not of said Products. It is understood that these checks are carried out as soon as possible and within a maximum period of one (1) month.

If the nonconformity of the Product (s) is confirmed, the Seller will then proceed, at the choice of the Buyer:

         the reimbursement of the Product (s) which is not in conformity or affected by a hidden defect, as well as shipping costs, the bank account debited at the time of the order or by sending a bank check within thirty (30) days after receipt of the Non-Conforming Product (s),

         the exchange of the Product (s) which is not in conformity or which is affected by a defect at the request of the Buyer. The sending of the Products to the Buyer is done at the expense of the Seller and according to the conditions of these Terms.

 

7 RIGHT OF WITHDRAWAL

The Purchaser has a cooling off period of fourteen (14) days from the date of delivery of the order, to return the Product (s) ordered, without having to justify reasons or pay penalties, except for the expenses of return that are his responsibility.

The Buyer must fill in a request for return / exchange and send it to the following address contact@bachca.com.

Upon receipt, the Seller acknowledges receipt of this request by sending an e-mail or letter.

The Purchaser then has a period of fourteen (14) days to return to BACHCA - 142 Rue de Rivoli, 75001 Paris, the (s) product (s) full (s), not used (s), in his ( their original packaging intact and as far as possible accompanied by their original packaging and the return receipt and a copy of the invoice. Failing the return of products within fourteen (14) days, from the day of the actual receipt of the order, the order is considered final and no refund may be made, except as provided herein GCS.

The Seller undertakes to reimburse the Buyer for all sums paid. The refund is made according to the method of payment used by the Buyer, within a maximum period of fourteen (14) days after receipt of the buyer's refund request mail.

The refund of this amount will be deferred until the recovery of the returned goods.

The costs of returning the goods remain however the responsibility of the Buyer.

8 PERSONAL DATA

8.1 NOMINATIVE INFORMATION

The information of personal information collected in the context of distance selling is mandatory, this information is necessary for the processing and delivery of orders and for the preparation of invoices. This information is strictly confidential, it is used only by the Seller or its subcontractors, subject to the same obligations, for the processing of orders only.

It is recalled that the Buyer has a right to access, modify, rectify and delete personal information collected about him.

The Buyer may receive from the Seller information emails about the products and activities of the Seller, if the Buyer has previously consented. The Buyer retains the right to refuse such communication either a priori by not giving his consent at the time of validation of the order, or a posteriori by expressing his refusal by email.

 

8.2 COOKIES

9 VARIOUS STIPULATIONS

9.1 FORCE MAJEURE

No Party is responsible for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure.

The Party invoking an event constituting force majeure shall notify the other Party within five (5) working days following the occurrence of this event.

The Parties agree that they must consult each other as soon as possible in order to jointly determine the execution of the order during the period of force majeure.

Beyond a period of one (1) month of interruption due to force majeure, the Seller may not honor the order, provided that it reimburses the Buyer if necessary.

 

9.2 PARTIAL NON-VALIDITY

If one or more stipulations of the present GSC are considered as invalid or declared as such under a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations retain all their strength and their reach.

 

9.3 ENTIRE AGREEMENT

These Terms and the order summary sent to the Buyer form a contractual whole and constitute the entire contractual relationship between the Parties.

In case of contradiction between these documents, the GSC will prevail.

 

9.4 MODIFICATION OF THE GTCS

It is specified that the Purchaser may save or print these Terms, provided however not to change them.

The current GTC can be consulted at any time under the heading "General Conditions of Sale" accessible via all pages of the Site.

The Seller may at any time update these Terms. Such an update is subject to prior and specific notification on the Site.

 

9.5 APPLICABLE LAW

These Terms and the contractual relations between the Buyer and the Seller are subject to French law.
